This Data Use and Protection Policy describes how Black Cellar Market LLC (“we,” “our,” or “us”) collects, processes, stores, and protects data when you use our platform at theblackcellar.com/market. This policy supplements our Privacy Policy.
1. Data We Collect
We collect only the data necessary to operate the Platform and serve your membership. This includes business identification details, contact information, transaction and payment history, and communication records. All data is collected with a defined purpose and is not retained beyond what is necessary.

- To review and process your membership application
- To manage your account and fulfill product orders
- To track installment payment activity
- To report trade line data to commercial credit bureaus (see Section 3)
- To communicate with you about your account, orders, and platform updates
- To comply with applicable legal and regulatory obligations
3. B2B Credit Reporting
Black Cellar Market LLC may report member payment activity to one or more commercial credit bureaus, which may include Ansonia Credit Data, Experian Business, Equifax Business, Dun & Bradstreet, CreditSafe, NACM, or other reporting agencies at our discretion. This is disclosed at the time of membership application and is a core feature of the Platform. Reported data may include:
- Business name and identifying information
- Trade line open date and credit limit
- Payment history (on-time, late, or defaulted)
- Outstanding balances on installment plans
4. Data Security
We use industry-standard security practices to protect your data, including encrypted data transmission, access controls, and PCI-compliant payment processing. Card data is never stored on our servers. While we take reasonable precautions, no system is entirely risk-free. We will notify you in the event of a breach as required by applicable law.
5. Data Retention
We retain your business and account data for a minimum of 5 years following account closure to meet legal obligations, maintain accurate credit reporting records, and resolve disputes. Anonymized analytics data may be retained indefinitely.
6. Your Data Rights
You may request access to, correction of, or deletion of the data we hold about you, subject to our legal retention obligations. To dispute or remove credit reporting data, requests must be directed to the applicable reporting bureau. We cannot modify trade line records that have already been submitted.
7. Third-Party Services
We work with vetted third-party service providers to operate the Platform. These providers process data only as necessary to perform their services and are bound by confidentiality obligations. We do not sell your data to any third party.
8. Updates to This Policy
We may update this Policy as our practices evolve. Changes will be posted on this page with a revised effective date.
